1. Acceptance of Terms

By accessing or using the Canary Edge platform, APIs, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Canary Edge provides a cloud-based anomaly detection API powered by machine learning models. The Service includes REST API endpoints for time-series anomaly detection, a web dashboard for monitoring and configuration, and related developer tools and documentation.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. API Usage

Your use of the API is subject to the rate limits and data point quotas associated with your plan tier. You agree not to:

  • Exceed the usage limits of your plan without upgrading
  • Share API keys with unauthorized third parties
  • Use the API for any unlawful purpose
  • Attempt to reverse-engineer the detection models
  • Resell or redistribute API access without written authorization
  • Interfere with or disrupt the integrity or performance of the Service

5. Payment and Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law or as explicitly stated in these Terms. We may change pricing with 30 days advance notice. Overages beyond your plan limits may result in additional charges or throttled access as described in your plan documentation.

6. Intellectual Property

The Service, including all models, algorithms, software, and documentation, is the intellectual property of Canary Edge and its licensors. You retain ownership of any data you submit through the API. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Canary Edge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Termination

Either party may terminate these Terms at any time. You may terminate by closing your account. We may terminate or suspend your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases. We will make your data available for export for 30 days following termination, after which it may be deleted.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
